LEASE

This lease made this __________ day of _____________________ ,20 ______ , by and between

________________________________________ , called Landlord, and

_______________________________________, called Tenant.

1. Term and Rent. Landlord hereby agrees to lease to Tenant the apartment located at:

for a term of _________ months, beginning ____________________ ,20 _______

at a rent of _________________________________________________ Dollars

( _________ ) per month, payable in advance, without demand, and payable thereafter on the _______ day of each and

every month. Rent is due on the 1st of the month. If the rent is not paid in full by the 1st, a penalty of $5 per day will be imposed until the rent has been fully paid. Rent is considered received on the date postmarked on the envelope by the United States Postal Service. After the expiration of the original term of this lease then rental shall be on a month to month basis thereafter, with all terms and conditions as herein provided.

2. Deposit. Tenant shall deposit with Landlord __________________________________

_________________ Dollars ($ _________ ) as security for rent and performance of this lease. Landlord will return the deposit fifteen (15) days after termination of the lease or vacation of the premises, whichever is later, after deducting amounts due Landlord for damages or other obligations of Tenant to Landlord. Tenant is specifically informed that the deposit is for Landlord's protection and may not be used by tenant in payment for rent at any time.

3. Notice of Moving. Tenant shall give thirty (30) days notice to Landlord of intent to move at the end of the term and should he fail to do so shall be liable for rent for the next successive thirty (30) day rental period.

4. Number of Tenants. The premises are to be occupied by no more than _______ and no additional residents and no subletting shall be allowed unless written permission is given by the Landlord.

5. Utilities. Tenant shall pay for the following utilities:______________________________

6. Inspection. Landlord and his agent have the right of free access to inspect, repair, alter or to exhibit for sale or rental any part of the premises whenever the same shall become necessary at the option and sole discretion of the Landlord. If Tenant is not personally present to open and permit entry into said premises, Landlord or his agent may forcibly enter the same without rendering Landlord or his agent liable to any claim or cause of action for damages by reason thereof, except where ordinary and reasonable care has not been taken to protect the Tenant's property.

7. Insurance. Tenant has inspected said premises and accepts the same as to condition and state of repair. It is understood that Landlord carries fire and hazard insurance on the real estate only and all personal property placed in the leased premises shall be at the sole risk of the Tenant and the Landlord shall not be liable for the loss, destruction, theft of or damage to such property from any cause whatsoever, specifically including acts of omission of Landlord and his agents.

 

 

8. Repair and Damage. Tenant shall pay for repair and replacement of all broken windows, window shades, light fixtures, light bulbs and locksmith fees to unlock doors or replace lost keys. All stopped plumbing lines (waste lines only), including garbage disposal, shall be opened by a licensed plumber or person approved by Landlord and paid by Tenant. All hot and cold water supply lines, including washers in spigots, shall be serviced by Landlord or his agent and paid by Landlord. tenant must report to Landlord all visible leaks in plumbing system within twenty-four (24) hours.

9. Use and Occupancy. Tenant agrees that he will use the premises for ______________________________________ and for no other purpose; not use or permit the premises to be used for any disorderly or unlawful purpose, nor permit any act or omission under his control that works or causes damages, inconvenience, or annoyance to any other occupant of the building; obey all laws, ordinances, regulations and orders of all governmental agencies having jurisdiction of the premises and of its use and occupancy; not assign this lease nor sublet the whole or any part of the premises without the written consent of the Landlord; not allow any gasoline or other combustible materials to be kept in the premises nor permit anything which would increase the Landlord's insurance; conform to the rules and regulations made by Landlord from time to time for the management of the building and grounds; not keep any live animals of any description in the premises without the written consent of the Landlord; not obstruct the halls, stairways, driveways, sidewalks, or other common areas in any manner; and to keep clean and free from rubbish,

garbage, dirt, snow, ice and leaves the following areas:___________________________.

 

10. Abandonment by Tenant. If Tenant leaves said premises unoccupied at any time and the rent is due and unpaid, Landlord may take immediate possession thereof, prohibit Tenant from reentering said premises, and remove and store at the expense of said tenant all property found contained therein. Landlord shall not be liable for the loss, theft or destruction of any of said property for any cause whatsoever. If Tenant fails to claim said property within thirty (30) days after Landlord takes possession, then Landlord is authorized to sell, give away or otherwise dispose of said property without incurring any financial obligation for having done so.
